I, the undersigned, hereby acknowledge that I am at least eighteen (18) years old, or the parent and/or legal guardian of the minor set forth below, and in consideration of Birdies on Vine Street, LLC (hereinafter referred to as “Birdies”) furnishing services and/or equipment to enable me, or the minor for which I am executing, to participate in Axe Throwing, acknowledge and agree as follows:

 

I hereby acknowledge that I understand that there are inherent risks and dangers that exist as a result of my use of Birdies’ Axe Throwing equipment and my participation in Axe Throwing activities.  My participation in such Axe Throwing activities and/or use of such equipment may result in my injury or illness including but not limited to bodily injury, disease strains, fractures, partial and/or total paralysis, eye injury, blindness, death or other ailments that could cause serious disability.  I hereby acknowledge that the above risks and dangers may also be caused by the negligence of others, accidents, breaches of contract, the forces of nature or other causes, and Birdies’ and/or Birdies’ employees or agents have no responsibility or control over the negligent actions of others. I hereby acknowledge that even in light of these risks and dangers, I still wish to participate in Birdies’ Axe Throwing activities and avail myself to the risks and dangers and hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or conduct of others.

 

I hereby agree to participate in the Axe Throwing activities in a safe and reasonable manner at all times, to adhere to any posted rules or codes of conduct, including wearing proper safety equipment and closed-toe shoes, as may be required.  I understand that in the event I fail to participate in a safe and reasonable manner as may be determined by Birdies and/or Birdies’ employees or agents, Birdies and/or Birdies employees or agents have the right to exclude me, without refund, from participating in the Axe Throwing activities, including restricting me from patronizing Birdies in the future, as they may determine to be necessary for the safety of myself and others.
